High Court dismisses petition, park to be built on agricultural produce market land
Bilaspur 27 June 2023. The way has been cleared for the construction of Gems and Jewelery Park in Raipur, Chhattisgarh. The High Court dismissed the petition as baseless. With this, the ban on the construction of the park has been lifted.
Devjibhai Patel, former MLA of Dharsinwa and former president of Krishi Upaj Mandi Samiti Raipur, had filed a public interest litigation in the High Court through advocates Kishore Srivastava, Himanshu Sinha, Shashank Thakur and AV Sridhar. In this, the order dated June 11, 2020, was challenged stating that the land allotted for the establishment of the all-convenient Gems and Jewelery Park in Agricultural Produce Market, Raipur, was against the rules.
It was said in the petition that the land of Mandi Committee was bought by the farmers in 1975. The owner of his land is entitled to the agricultural produce market, Raipur. Under the Agricultural Produce Market Act, the land of the committee can be used only for the purpose of the market. Cannot be used for any other purpose. It was also stated in the petition that in a single day on June 11, 2020, the state government, directing 5 to 6 agencies, allotted land for the park contrary to the Agricultural Produce Market Act.
The High Court had banned
After hearing the petition filed from the year 2020, the Division Bench of the High Court had banned any kind of construction work till the final hearing of the case, since then the stay order remained in force in the case. During the hearing of the case on Tuesday, after hearing the arguments of Advocate General Satishchand Verma, Vikram Verma and the petitioner’s advocates on behalf of the state government, the High Court dismissed the petition as baseless. With this order, the earlier ban has also been removed and the way has been cleared for opening of Gems and Jewelery Park at Pandatarai in Raipur.
