Raipur / Bilaspur September 24, 2020. In a single bench of the High Court today, Justice Gautam Bhaduri has granted stay on transfer, hearing the transfer petition of PD Sayy Chief Engineer Public Works Department, Jagdalpur Bastar. Along with this, the court has issued a notice to the secretary of the PWD department seeking an answer in 4 weeks.
Let us tell you that PD Sai, who is currently posted as Chief Engineer in Public Works Department Jagdalpur, was transferred from Jagdalpur to General Manager Chhattisgarh Road Corporation Raipur. He had challenged in the High Court through his senior advocate Sandeep Dubey, Shantam Awasthi and stated that the transfer order issued on 15 September was against the law, as he was transferred to the Road Corporation which is formed by the Companies Act. Their consent was not obtained before the transfer, as the Road Corporation was not their cadre department.
It is also written in the road corporation setup that posts will be filled by deputation and those who have been transferred are not eligible for that post. According to the state circular also, a junior cannot be posted as long as the senior officer is posted.
Explain that the Secretary of the Government did the transfer at the behest of the high officials. After the hearing, the Court has given an adjournment in 4 weeks from the Secretary, Public Works Department, giving the adjournment.
