The Supreme Court, while hearing the state reservation case, has justified 58 percent reservation. The Supreme Court has changed the decision of the Chhattisgarh High Court banning 58 percent reservation. After which it is now believed that the recruitment in the state will be done on the basis of 58 percent reservation. However, this relief is only interim. That means recruitment can be done till the next hearing or new facts. No final decision has been taken on this yet. Due to the reservation dispute, recruitment and entrance examinations have been stalled here for almost two years.

In November last year itself, the High Court had banned 58 percent reservation while hearing. The matter went to the Supreme Court on behalf of the state government. Now the instructions of the Supreme Court are being seen as a big relief in this matter. Soon the government can present its stand on this, after that the situation will be clear on recruitment and other reservation based processes.

After this instruction of the Supreme Court, the Chief Minister of the state Bhupesh Baghel said – We all welcome the decision of the Supreme Court to stay the decision of the High Court on 58% reservation. High Court had rejected
About 7 months ago, the Chhattisgarh High Court rejected it while giving an important decision regarding the 58 percent reservation implemented here. The Chhattisgarh government had issued a notification of 58 per cent reservation in 2012, which has been quashed by the High Court. The court said that increasing the reservation from 50 to 58 percent is unconstitutional. The court also considered it wrong to give reservation according to the population.

What was the system according to 58 percent
The state government had issued a notification on January 18, 2012, changing the reservation policy, under which amendment was made in section 4 of the Public Service (Reservation of SC, ST and Backward Classes) Act, 1994. Accordingly, a provision of 32 per cent reservation was made for the Scheduled Castes, 12 per cent for the Scheduled Castes and 14 per cent for the Backward Classes.

76 percent reservation case stuck
On 2 December 2022, the Congress government of the state has passed the Chhattisgarh Public Service (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Amendment Bill and Educational Institution (Reservation in Admission) Amendment Bill. In both these Bills, the reservation ratio has been fixed at 32% for tribal class-ST, 13% for Scheduled Caste-SC and 27% for Other Backward Classes-OBC. There is also a proposal to give 4% reservation to the poor of the general category. By combining this, Chhattisgarh would have got 76% reservation, but this bill is still pending with the Governor for his signature.
