Bilaspur. The state government has received a setback from the High Court in the matter of reservation in promotion. The High Court has rejected the demand of the state government to amend or cancel the order banning reservation. The case will be heard by Chief Justice Ramesh Sinha and N.K. It is happening in the divisional bench of Chandravanshi. Let us tell you that in the last hearing, the High Court had reserved the decision after the completion of the hearing. Actually, the state government had issued a notification for reservation in promotion in the state on 22 October 2019. Under this notification, it was said that the benefit of reservation in promotion will be given to class I to IV employees. In this, a provision of 13 percent reservation has been made for Scheduled Castes and 32 percent for Scheduled Tribes. In the notification issued, it was made clear that this reservation will be for promotion from first class posts to first class higher pay scale posts, from second class posts to first class posts. Will be given on promotion to Class III posts and on promotion to Class III posts. S. of Raipur against this notification of the state government. Santosh Kumar filed a PIL challenging it in the High Court through advocate Yogeshwar Sharma. In the petition, demanding the cancellation of the notification issued by the state government, it was said that this decision of the state government is contrary to the order of the Supreme Court and the reservation rule.

After hearing the petition, the High Court had stayed the notification issued by the state government. On December 2, 2019, Advocate General Satishchandra Verma, on behalf of the government, had accepted the mistake in preparing the notification. The court had given one week’s time to rectify this mistake. When there was no specific implementation on this, the division bench of the then Chief Justice PR Ramachandra Menon and Justice PP Sahu had stayed the notification, and ordered the government to make the rules again within two months.
