Raipur, 12 May 2022. Governor and Chancellor Ms. Anusuiya Uikey has directed the government to take necessary action as per law without any delay in relation to attachment of movable and immovable properties of Pandit Ravi Shankar Shukla University, Raipur. In this regard, the Secretary to the Governor, Shri Amrit Kumar Khalkho wrote a letter to the Secretary, Higher Education Department, apprising him about the instructions of the Governor. In the letter, a request has been made to direct Standing Council Dr. Rajesh Kumar Pandey for speedy hearing in the appeal case pending in the Supreme Court.
The letter sent by the Secretary to the Governor is as follows-
Subject:- Regarding attachment of movable and immovable property of Pandit Ravi Shankar Shukla University, Raipur.
Regarding the subject, the copy of the letter dated 27.04.2022 received by the Registrar, Pandit Ravi Shankar Shukla University, Raipur addressed to Collector, Raipur and endorsed to this Secretariat is attached with the papers.
It is clear from the examination of the said letter of the University and from the examination of the papers that in compliance of the order passed by the Honorable Fourth Additional District Judge, Raipur on 26.04.2022, in lieu of non-payment of additional amount from the compensation in the said land acquisition case. Three vehicles of the university have been confiscated.
The first appeal presented by the Government has been dismissed by the Hon’ble High Court on 29.11.2019 not finding sufficient reason for the delay, against which the special leave petition (C) was written by the Government to the then Government Deputy Advocate dated 31.01.2020. ), whose interim application numbers are 7987/2021 and 7988/2021. The matter is presently pending in the Hon’ble Supreme Court against the decision of Hon’ble Chhattisgarh High Court dated 29.11.2019.
As per the directions of Hon’ble Governor and Chancellor, it is requested that keeping in view the situation shown in the attached letter, take the trouble of taking necessary action as per law without delay.
In this regard, the Government will take the trouble of directing the Standing Council Dr. Rajesh Kumar Pandey for speedy hearing in the pending appeal case in the Hon’ble Supreme Court.
